Reasons for the Inquiry

Dirty Trick Lawyers are a Threat to the Public

An independent investigation has resulted in the need for an application to the Constitutional Court to Order an Independent Commission of Inquiry into allegations of unlawful and unconstitutional conduct by lawyers practising in Kwazulu Natal.

The investigation has uncovered a System of Law that is inconsistent with the Constitution.

Hundreds of cases handled by a particular group of lawyers are to be investigated by a Commissioner in order to identify a pattern of misconduct.

One System of law that is known to everyone is based on the Constitution and the Law. The other System, not known to everyone, is based on neither the Constitution nor the Law and which is not good.

Lawyers are officers of the court. Officers of the court are expected to display conduct which respects the Constitution and the Law.

Lawyers who act unlawfully and unconstitutionally are collectively referred to as “Dirty Tricks Lawyers”.

Dirty tricks lawyers are a threat to the public.

In the current investigation the System that has been exposed, includes a litigation pattern that results in Lawyers seizing immovable property (house or farm) in an unconstitutional manner. d

The public interest is protected by the Constitution which treats any "Bill of Rights" threat to the Public - as a threat to the Constitution.

Examples of Unlawful and Unconstitutional conduct are included in Edition 1.

A commissioner should investigate and implement measures to inform & protect the public (and the profession) from the threat.

The South African Constitution [Section 38 of the Constitution] provides for the means to deal with the threat.
